Terms And Conditions

Program Period

1. This Citibank Berhad ("Citibank") "Citibank Electronic Statement" Promotion ("Promotion") will run from 13 March 2009 to 31 May 2009 (both dates inclusive) ("Promotion Period").

Eligibility

2. Subject to clause 3 below, all principal Citibank credit cardholders who are residents of Malaysia and have not previously enrolled to receive Electronic Statements are eligible to participate in this Promotion ("Eligible Customers") by enrolling themselves in the following manner:

(a) by login via the Citibank Online Website at url address www.citibank.com.my ("Citibank Online"); or
(b) via other channels including but not limited to submitting the e-statement enrolment form, sending a short messaging service text ("SMS"), fax, post and electronic mail.

3. The following persons are NOT eligible to participate in this Promotion:

(a) Permanent and/or contract employees of Citibank (including its subsidiaries and related companies) and their immediate family members
(b) Holder(s) of Citibank credit card(s) not issued in Malaysia;
(c) Holder(s) of Citibank credit card(s) who is (are), in default of facilities granted by Citibank at any time from the start of the Promotion Period until the winner selection process is completed, subject to Citibank's discretion.
(d) Representatives and/or agents (including advertising and promotion agents) of Citibank and their immediate family members.

The Promotion

4. Where an Eligible Customer has successfully enrolled to receive Electronic Statements for a particular account, his/her other accounts that are linked to that account will be automatically enrolled to receive Electronic Statements. shall be entitled to participate in this Promotion.

The top 155 Eligible Customers who recorded the highest number of Qualifying Retail Transactions throughout the Promotion Period (based on the total spending per Eligible Customer regardless of the number of Citibank credit cards held by them) will receive the following rewards ("Rewards") in accordance with the total number of Qualifying Retail Transactions obtained by them:

Next 100 Eligible Customers: Samsung Bluetooth Headset WEP250

6. In the event of a draw for a Reward or if the Eligible Customer is disqualified for any reason, the next Eligible Customer with the highest relevant collective total spending on Qualifying Retail Transactions throughout the Promotion Period (based on Citibank’s records) will be selected instead for the relevant Reward.

7. Qualifying Retail Transaction refers to retail purchases of a minimum of RM50 and above in a single receipt, both local and international, online bill payment, mobile bill payment and new easy payment plan (but not installment). Split Qualifying Transactions are disallowed and shall be disqualified. For the avoidance of doubt, Split Qualifying Transactions mean Qualifying Transactions that are not accumulated in a single receipt.

8. In addition to the above, the first fifty (50) Eligible Customers who enrolled for the Promotion by login via Citibank Online shall also be entitled to receive one (1) McAfee VirusScan Plus Antivirus Software worth RM110.

9. The relevant Eligible Customers who have been awarded with the Reward will be notified by Citibank either in writing or by phone latest by 31 July 2009. For the avoidance of doubt, the Eligible Customer is NOT deemed to be selected to receive the Reward if the Eligible Customer did not receive any notification in writing or via phone from Citibank by 31 July 2009.

10. The following additional terms and conditions shall apply to the Reward:

(a) All cost in respect of the installation expenses, transportation expenses as well as any other expenses, in relation to the Reward shall be borne solely by the Eligible Customers;
(b) Citibank retains the sole discretion to select the colour of the Reward;
(c) The Reward will be delivered to the Eligible Customers at a date to be stipulated by Citibank;
(d) Citibank expressly excludes and disclaims any representations, warranties, or endorsements, expressed or implied, written or oral, including but not limited to, any warranty of quality, merchantability of fitness for a particular purpose in respect of all the Reward;
(e) The Reward is subject to availability from the supplier. Citibank reserves the right at its absolute discretion to substitute any one of the Reward with another model of similar retail value at any time without prior notice;
(f) The Reward is provided on an “As Is” basis and does not include any accessories or items that are shown in all materials, as they are for illustrative purposes only;
(g) The title in the Reward and any risks of losses or damages to the Reward passes to the Eligible Customers upon delivery of the Reward to the Eligible Customers. Citibank shall not be liable for or obliged to recognize or replace any defective, lost, damaged or stolen Reward.
(h) Citibank does not accept any liability whatsoever (including negligence) with respect to any injury, losses, damages or accidents arising from the use of the Reward by the Eligible Customers;
(i) The Reward is non-transferable to any 3rd party, non-exchangeable for up-front cash, credit or kind, whether in part or in full.
(j) Eligible Customers are only entitled to receive the Reward once throughout the Promotion Period.
(k) In the event of late delivery of the Reward or queries in relation to the Reward, Customers may contact Citiphone, at the following telephone numbers: 03-2383 0000 (Kuala Lumpur), 04-296 0000 (Penang), and 07-268 0000 (Johor Bahru) ("Citiphone").

11. In the event that the Reward are awarded to and received by persons who:

(a) are not Eligible Customers in the Promotion; and/or,
(b) have committed or are suspected of committing any fraudulent or wrongful acts in relation to use of their Citibank credit card(s) and/or any transactions made thereof;
Citibank reserves the right to disqualify such persons from participating in the Promotion and/or from redeeming or using the Reward.

12. Citibank shall not be liable for any default in respect of the Promotion due to any act of God, war, riot, strike, lockout, industrial action, fire, flood, drought, storm, technical or system failures or any event beyond the reasonable control of Citibank.

13. Citibank's decisions on all matters relating to the Promotion, including the determination of Eligible Customers shall be final and binding and no further correspondence or attempts to dispute such decisions will be entertained.

14. Citibank reserves the right to cancel, terminate or suspend the Promotion without any prior notice. For the avoidance of doubt, any cancellation, termination or suspension by Citibank of the Promotion shall not entitle the Eligible Customers to any claim or compensation against Citibank for any and all loss or damage suffered of incurred by the Eligible Customer as a direct and indirect of the act of cancellation, termination or suspension.

15. For the avoidance of doubt, these Terms and Conditions shall prevail over any provisions or representations contained in any brochure or other promotional materials advertising the Promotion.

16. Citibank reserves the right at its absolute discretion to vary, delete or add to any of these Terms and Conditions from time to time without prior notice.

17. To the fullest extent permitted by law, in no event will Citibank or any of its officers, servants, employees, representatives and/or agents (including without limitation, any third party service providers that Citibank may engage for purposes of the Promotion) be liable for any loss or damages (including without limitation, loss of income, profits or goodwill or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise in connection with the Promotion, even if Citibank has been advised of the possibility of such damages in advance, and all such damages are expressly excluded.

18. By participating in the Promotion, Eligible Customers agree to be bound by these Terms and Conditions and any decisions of Citibank, and the Eligible Customers hereby give their consent to and authorise Citibank to disclose their particulars to third party service providers engaged by Citibank for the purposes of this Promotion, if any. Citibank warrants that the disclosure of such particulars to any third party service providers, if any, shall be limited to the Eligible Customer's name, address and telephone number and shall be used only in relation to and for the purposes of this Promotion.
