Terms and Conditions (T&C)

1. The "Win MacBook & iPod Touch Games Promo" ("the Promotion") is only applicable to DIGI TELECOMMUNICATIONS SDN BHD (Company No. 201283-M) ("DiGi") subscribers who have downloaded the games successfully during the Promotion Period. The Promotion starts from 0000 5th January 2009 GMT +8 until 2359 1st February 2009 GMT +8 and/or any such period as determined by DiGi ("Promotion Period").
2. The following MSISDNs are not eligible to participate in this promotion:
• MSISDN registered as a DiGi company account;
• MSISDN registered as a DiGi Dealer account;
• MSISDN registered under the sponsor's corporate name or individual
name.
3. The Promotion is open to all DiGi lines except to those mentioned in Item 2 above ("the Participants").
4. Each MSISDN can download the a game once every three (3) days to a particular handset throughout the activation period of that particular MSISDN and any subsequent re-download within the three (3) days will receive an error message.
5. The following is the selection criteria in determining the winners:
• The participant who downloaded the most games from the Promotion
minisite.
6. The prizes for the Promotion are as follows:
• 1 X Apple MacBook
• 2 X iPod Touch
7. Prizes are not transferable, exchangeable for cash, credit or kind.
8. Pictures or images of the prizes for redemption are solely for the purpose of illustration only. Terms and conditions governing the prize items apply.
9. DiGi and/or the sponsors reserve the sole and absolute right to choose the colour and/ or the model of the Prizes and/ or to substitute the prize with an item of equal value without giving prior notice to the Participant.
10. Each MSISDN is only entitled to win one prize throughout the Promotion Period.
11. Winners will be determined when the Promotion ends.
12. The judges' decision in determining the winners is final and no further correspondence will be entertained.
13. The winner's MSISDN must be active at the time of notification on prize collection.
14. The winners may be governed by separate terms and conditions imposed by the sponsors and/or from any other third party from which the prizes are procured.
15. The winners will be contacted by DiGi via their MSISDN within 5 business days ("Notification Period") upon receiving the prizes from the sponsors. Participants are encouraged to keep their MSISDN activated during this Notification Period.
16. DiGi shall make three (3) attempts in 2 business days to call each of the Prize Winners.
17. The prizes will be couriered to the winners and proof of sending will be the final and conclusive proof of receipt of the prizes by the winners.
18. Once all the winners have been contacted, the winner's list will then be posted on the DiGi website within 30 working days. The details of winners will be posted at http://www.digi.com.my/whatshot/promotions/promo_winner/index.do.
19. DiGi reserves the right to publish or display details of the winners for any purpose including, but not limited to, advertising and publicity without any prior written consent from the winners.
20. In the event a winner is found to be ineligible (as per Clause 2 above) at any point in time during or after the Promotion Period, DiGi reserves the right to disqualify the said winner and to cancel/ withdraw/ recall the Prize from being delivered to the ineligible winner. If the Prize has been delivered to the ineligible winner, the ineligible winner hereby agrees and undertakes to return the Prize to DiGi without any claim whatsoever, failing which, DiGi shall have the right to initiate any action it deems necessary against the ineligible winner.
21. In the event DiGi is unable to contact a particular winner, that winner will automatically be disqualified and DiGi reserves the right to keep the prizes to be used for another promotional activity.
22. The winners that are disqualified pursuant to this clause hereby agree that they will not make any claim and/or demand whatsoever to DiGi for prizes.
23. DiGi does not warrant that the Promotion will be uninterruptible and/or error free.
24. By participating in the Promotion, the Participants hereby acknowledge and irrevocably agree that DiGi shall not in any manner be liable for any interruption and/or error arising from the Promotion.
25. To the fullest extent permitted by law, DiGi and the sponsors hereby expressly excludes and disclaims any representations, warranties, or endorsements, express or implied, written or oral, including but not limited to, any warranty of quality, merchantability or fitness for a particular purpose in respect of the prizes.
26. DiGi and/ or the sponsors shall not be liable for any claim(s) of loss or damage to property or any personal injury or loss of life resulting from, or in connection with this Promotion and/ or the prizes given under this Promotion.
27. DiGi shall not be liable in any manner whatsoever for any loss or damage (including without limitation loss of income, profit or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with the Promotion and/or the prizes, even if DiGi has been advised of the possibility of such damages in advance, and all such damages are expressly excluded.
28. DiGi shall not be liable for any defaults due to acts of God, wars, riots, strikes, lockouts, industrial actions, fires, floods, droughts, storms or any event beyond the reasonable control of DiGi.
29. DiGi's decision on all matters relating to the Promotion will be final and binding on all Participants.
30. DiGi reserves the right to cancel, terminate or suspend the Promotion with or without any prior notice. For the avoidance of doubt, cancellation, termination or suspension by DiGi of the Promotion shall not entitle the Participant to any claim or compensation against DiGi and DiGi shall not be liable and held responsible for any losses and/ or damage suffered or incurred by the Participant as a direct or indirect result of the act of cancellation, termination or suspension by DiGi.
31. DiGi reserves the right at its absolute discretion to vary, delete or add to the Terms and Conditions from time to time without prior notice.
32. By participating in the Promotion, Participants agree to be bound by these Terms & Conditions and the decision of the judges.
33. DiGi reserves the sole and absolute right to use the information or publish any related matter to the entries including but not limited to the winner's names and photographs for any purpose whatsoever.
34. All eligible subscribers agree to be bound by the official rules and regulations and decisions of DiGi.
35. A failure by DiGi to enforce any of these Terms and Conditions in any instance(s) shall not give rise to any claim by any person.
36. All other terms and conditions governing the use of any of DiGi's mobile telecommunication services in relation to the utilisation of the Promotion shall apply herein, mutatis mutandis.
